TERMS AND CONDITIONS ON STORE PURCHASES

INTERNATIONAL ORDERS

Please note that if the order you are about to place has a billing or shipping addresses located outside of the USA (herein, "International Order"), we need you to contact us ahead of your purchase so that we can quote you an accurate shipping price. Please also know that, for international orders, we can process your order through one of the following two payment methods we offer you:

1. Credit card via PayPal, bank account via PayPal, or simply PayPal account balance
If you want to use your credit card, we suggest you do it through the use of a PayPal account that you can set up within only 1 or 2 minutes. You could alternatively pay with bank funds through a PayPal account. If you are setting up and using a PayPal account for the first time, however, please just know that completion of the transaction by credit card will be much faster than the process to set up PayPal and make payment through bank funds. The quickest and easiest option is to simply use any available PayPal balance you may have if you have an existing PayPal account. The reason you would want to use PayPal via any of these three different payment methods is because it secures the transaction equally for both you (buyer) and us (seller). This means that if the items are lost, stolen, never received, etc., you should first contact us at cs@chainstop.com to correct the problem for you. If you receive confirmation from us that we have received your request to correct the problem and/or we do not correct the problem or refund your money within a reasonable/feasible amount of time, you can file a claim and PayPal will refund your money. PayPal also protects us against fraud if a criminal were to use a stolen credit card for the purchase. In order for PayPal’s “Purchase Protection” to apply to your purchase and for us to ship out your merchandise, you need to indicate the correct “ship to” address at the time that you are going through the short steps involved in paying this PayPal invoice.

We can expedite shipping if your order is time-sensitive. Please indicate the "ship to" address. PayPal will confirm for us whether it is OK to ship to that address. If PayPal does not approve the address, we will let you know and request another address for PayPal to approve. Before paying, be sure to confirm the line item that shows the shipping service you want and what you will be paying for it. If PayPal approves your "ship to" address, we will ship out your order via the shipping service indicated within 3 business days (often within 1 business day, but not guaranteed). Before placing your order, please ask us about availability of the particular items you are ordering if you have a time-sensitive need for delivery.

2. International wire transfer or direct bank deposit
If you want to pay by international wire transfer, you will need to NOT make your purchase through our website, but to instead please e-mail us at cs@chainstop.com with part numbers, descriptions and the quantity you want to buy. We will send you an e-mail that includes in the body of the text or in an attached document the price per item, the shipping price and the total amount to pay. In order for us to fulfill your order when you pay by international wire transfer/bank deposit, the US Dollar amount that you transfer and deposit into our bank account will need to be the exact amount of the total (merchandise and shipping price) that we will quote you once you contact us. Please indicate this to the bank through which you will transfer the funds so that they calculate and adjust the amount you need to wire and so that it equals the total amount that needs to be deposited into our account AFTER all bank fees are charged. Should the amount that you deposit to the account not total the amount we quoted you, we will wait for you to pay the balance before we process your order for shipment.

Please do not place an order for which the "ship to" address is the location for a freight forwarder. We will not process orders going to freight forwarders. There are two exceptions:

1. You make payment for your order through the checkout page via PayPal AND PayPal indicates that that is an “OK” address to which we can ship your items. It will normally “OK” whatever address you indicate as the “ship to” address. We will inform you if PayPal does NOT approve your “ship to” address as one to which we can ship.

Or,

2. You make payment via wire transfer direct to our bank account with the exact procedure indicated above. In this instance you will need to NOT make your purchase through our website, but to instead contact us at cs@chainstop.com informing us that you want us to ship an order to a freight forwarder whose address we ask that you specify in that message.

Please note: You will be responsible for any applicable taxes and/or duties that may need to be paid upon delivery.

SHIPPING TERMS
Delivery by the carrier we use for shipment (most often UPS, occasionally USPS and rarely other carriers) will be completed without signature. If you require that the packages(s) be delivered only with a signature for proof of delivery and receipt, please indicate this to us before completing a payment for your order so that we can ensure that the proper shipping service is selected and covered in your payment. If you do not indicate that you require a signature, the confirmation of delivery to your shipping address (available from the tracking information we provide for your order) will serve as your acceptance that you received your order. The alternative is to indicate in the order comments (if you make your purchase online or via PayPal invoice) that you require your order to be delivered only with a signature indicating receipt of the item(s) shipped for your order. Before accepting delivery of the package(s) from the carrier with a signature, the person at your shipping address who signs for the package should carefully check the exterior packaging and its contents to ensure that the packaging and its contents are not damaged in any way, incomplete or inconsistent with what you ordered. Damage of the exterior packaging is sometimes an indication that the contents may have been damaged in transit. If an item that you ordered is damaged, incomplete or inconsistent with what you ordered, you must reject the package(s) and on that same day e-mail us at cs@chainstop.com to inform us that you rejected the package(s) and to indicate the reason you rejected it. Upon our receipt of that package and its contents as you describe, we can refund your money in full or send you a replacement for the item, if in stock. Just indicate to us which you prefer. If a replacement is not in stock, we will refund your money. You can also request that we follow up with you after the refund to inform you of when a replacement is back in stock.

REFUNDS AND RETURNS
Try buying and then returning your tire chains at retail establishments. It is very unlikely you will find a place that allows returns, but Chain STOP is different. If the items you ordered are delivered to you, but you still decide to return them for a reason other than those indicated above, we can give you a refund for the item(s) you purchased. The item(s) you return to us for a refund must be shipped back to us within 30 days of the date that they were first delivered to you. That/those item(s) must be in new, unused condition (which we will determine soon after receipt of the items), and you will need to show us your original copy of the receipt of your purchase. We will look for signs of wear, scuff marks, dirt or other damage that causes the chains to longer be in the same condition as the way they were shipped to you. To keep the chains in the new condition, you must not drive on them. If you need our opinion about fitment without you having driven on the chains, send us clear pictures from various angles both up close and at a distance to give us a feel for how you have installed the chains. This enables us to give you our assessment as to whether the chains fit. If the chains have been used, they are non-refundable.

We can issue you a full refund on the price you paid us for your tire chains with no restocking fee if you ship the items back to us via UPS Ground or USPS Priority Mail*(see asterisk note below) and e-mail us the tracking number within 2 calendar days of delivery to you. 15% restocking fee between 2 to 7 days of delivery. 30% restocking fee between 7-30 days. No returns are accepted after 30 days.

In purchasing your tire chains online, you accept the trade-off of convenience for the slight risk that your tire chains will not fit on your tires. As such, the original shipping price is non-refundable unless if Chain STOP committed an error such as shipping you chains other than what you ordered. Please note that a fitment issue is not an error; there is simply not 100% certainty over whether a particular tire chain size will fit a particular tire, since tire manufacturers do not all use the same standard for measurement and tire size labeling. Historically, only 2.5% of purchases have been returned to us for fitment issues. Fitment issues are unusual, but please know that they can happen. Accordingly, the shipping costs for the return must be prepaid by you unless Chain STOP indicates it will pay for that shipping cost due to its own error. Once the items are approved for return and delivered back to us, we will inspect the items and inform you of the result of our inspection. If your request for return and our authorization is due to an error on our part, if the items are returned to us within 30 days of their delivery to you, and if they are new and unused as determined by Chain STOP, we will issue you a refund on the price you paid us for your tire chains. Check for applicable restocking fees indicated above.

To initiate the return process, you must e-mail us directly at cs@chainstop.com with an explanation for why you want to return the merchandise. If you believe there is something wrong with the item that was delivered to you, you must contact us within 3 calendar days after the date of delivery of the merchandise you want to return. Your e-mailed request to return the merchandise must include clear images showing the issue (e.g., a design issue that makes installation unexpectedly not possible). Please be sure the pictures clearly show how the tire chains appear on your tire from your attempted installation. Those pictures should be taken from the front and at an angle. Also, when possible, please take a picture of how the chains look on your tire from the inner sidewall. These pictures will help us to see if there are any steps that we can advise you to take in order to properly install the chains. If we determine from the pics that the chains do in fact appear to be too large or small for your tires, we can then initiate a return so long as the chains remain unused and in new condition as will ultimately be determined by Chain STOP. 

In order for you to return your item(s), you must receive a return e-mail from us confirming our receipt of your request and authorizing you to return your item(s). You agree that before you attempt to obtain a refund directly through your credit card company or PayPal, you will show us a good-faith effort to resolve any issues with your order by contacting us directly at cs@chainstop.com and receiving a confirmation from us that we did receive your message. If you do not receive a confirmation of receipt of your e-mail within two business days, you agree to send a second e-mail message through our contact page AND to also call us at 800-553-7993. Your need to take the latter two steps is highly unlikely, and we normally respond to all e-mails within 24 hours....often in much less time than that. Returns will not be accepted without prior authorization. That return merchandise authorization (RMA) e-mail you receive from us will include the address to which we will require that the items be returned.

You should expect to receive your refund within four weeks of giving your package to the return shipper. In many cases, however, you will receive a refund more quickly. This time period includes the transit time for us to receive your return from the shipper (5 to 10 business days), the time it takes us to process your return once we receive it (3 to 5 business days), and the time it takes your bank to process our refund request (5 to 10 business days).

4. Limitations

In no event shall Chain STOP or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Chain STOP's Internet site, even if Chain STOP or a Chain STOP authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
